17 0fd75c45 2022-07-30 mischa Postfix admin (the software) can be used for free unless it is used in violation with
18 0fd75c45 2022-07-30 mischa the rules mentioned in 3.1 in the End User License Agreement. If you want to use
19 0fd75c45 2022-07-30 mischa the software outside the limitations set by 3.1 a commercial license is required. This
20 0fd75c45 2022-07-30 mischa license can be obtained by contacting the publisher mentioned in point 9 of this
24 0fd75c45 2022-07-30 mischa 2. LICENSE
25 0fd75c45 2022-07-30 mischa High5! (the company) grants you a non-exclusive license to use the Software on an
26 0fd75c45 2022-07-30 mischa unlimited installations subject to the provisions in all sections of this Agreement.
28 0fd75c45 2022-07-30 mischa The Company, at its discretion, offers a free download of Postfix Admin available on
29 0fd75c45 2022-07-30 mischa its web site. Use of this free download is also provided under the terms of this
30 0fd75c45 2022-07-30 mischa Agreement with the additional notice that no technical support or service for the free
31 0fd75c45 2022-07-30 mischa download will be provided by the Company. Use for sale or re-sale of the Software
32 0fd75c45 2022-07-30 mischa requires purchasing the license.
35 0fd75c45 2022-07-30 mischa 3. SCOPE OF GRANT
37 0fd75c45 2022-07-30 mischa 3.1 You are allowed to:
38 0fd75c45 2022-07-30 mischa a) customize the Software's design and operation to suit the internal needs of
39 0fd75c45 2022-07-30 mischa your web site and/or product
40 0fd75c45 2022-07-30 mischa b) produce and distribute the Software with additional modification. The
41 0fd75c45 2022-07-30 mischa modifications you personally create are not owned by High5! as long as they
42 0fd75c45 2022-07-30 mischa contain no proprietary coding from High5!
43 0fd75c45 2022-07-30 mischa c) create applications which interface with the operation of the Software
44 0fd75c45 2022-07-30 mischa provided said application is an original work.
46 0fd75c45 2022-07-30 mischa 3.2 You are not allowed to:
48 0fd75c45 2022-07-30 mischa a) permit other individuals to use the Software except under the terms listed
50 0fd75c45 2022-07-30 mischa b) reverse engineer, disassemble, or create derivative works based on the
51 0fd75c45 2022-07-30 mischa Software for distribution or usage outside your web site and/or product
52 0fd75c45 2022-07-30 mischa excluding those applications described above
53 0fd75c45 2022-07-30 mischa c) modify and/or remove any copyright notices or labels on the Software on
54 0fd75c45 2022-07-30 mischa each page (unless full license is purchased) and in the header of each script

56 0fd75c45 2022-07-30 mischa d) distribute the Software for sale or re-sale (unless full license purchased)

63 0fd75c45 2022-07-30 mischa 4. DISCLAIMER OF WARRANTY
64 0fd75c45 2022-07-30 mischa The Software is provided on an "AS IS" basis, without warranty of any kind, including
65 0fd75c45 2022-07-30 mischa without limitation the warranties of merchantability, fitness for a particular purpose
66 0fd75c45 2022-07-30 mischa and non-infringement. The entire risk as to the quality and performance of the
67 0fd75c45 2022-07-30 mischa Software is borne by you. Should the Software prove defective, you and not High5!
68 0fd75c45 2022-07-30 mischa assume the entire cost of any service and repair. In addition, the security
69 0fd75c45 2022-07-30 mischa mechanisms implemented by High5! Software have inherent limitations, and you
70 0fd75c45 2022-07-30 mischa must determine that the Software sufficiently meets your requirements. This
71 0fd75c45 2022-07-30 mischa disclaimer of warranty constitutes an essential part of the agreement.
75 0fd75c45 2022-07-30 mischa Title, ownership rights, and intellectual property rights in the Software shall remain
76 0fd75c45 2022-07-30 mischa with High5!. The Software is protected by copyright laws and treaties. Title and
77 0fd75c45 2022-07-30 mischa related rights in the content generated through the Software is the property of the
78 0fd75c45 2022-07-30 mischa applicable content owner and may be protected by applicable law. This License gives
79 0fd75c45 2022-07-30 mischa High5! no rights to such content.
82 0fd75c45 2022-07-30 mischa 6. TERMINATION
83 0fd75c45 2022-07-30 mischa This Agreement will terminate automatically upon failure to comply with the
84 0fd75c45 2022-07-30 mischa limitations described herein or on written notice from an authorized representative of
85 0fd75c45 2022-07-30 mischa High5!. On termination, you must destroy all copies of the Software within 48 hours.
86 0fd75c45 2022-07-30 mischa Termination of the license due to noncompliance will not result in any refunds of
87 0fd75c45 2022-07-30 mischa license fees.
90 0fd75c45 2022-07-30 mischa 7. MISCELLANEOUS
91 0fd75c45 2022-07-30 mischa High5! reserves the right to publish a selected list of users of the Software. High5!
92 0fd75c45 2022-07-30 mischa reserves the right to change the terms of this Agreement at any time however those
93 0fd75c45 2022-07-30 mischa changes are not retroactive to past releases. Changes to the Agreement will be
94 0fd75c45 2022-07-30 mischa announced via email using the High5! email notification list. Failure to receive
95 0fd75c45 2022-07-30 mischa notification of a change does not make those changes invalid. A current copy of this
96 0fd75c45 2022-07-30 mischa Agreement will be available upon request.
98 0fd75c45 2022-07-30 mischa Technical support will not be provided for third-party modifications to the Software
99 0fd75c45 2022-07-30 mischa including modifications to code, CSS, and Languages to any license holder. If the
100 0fd75c45 2022-07-30 mischa Software is modified using a third-party modification or otherwise, technical support
101 0fd75c45 2022-07-30 mischa may be refused to any license holder.
104 0fd75c45 2022-07-30 mischa 8. GOVERNING LAW
105 0fd75c45 2022-07-30 mischa This Agreement shall be governed by the Laws of the Netherlands. Any action in
106 0fd75c45 2022-07-30 mischa regard to this Agreement or arising out of its terms and conditions shall be instituted
107 0fd75c45 2022-07-30 mischa and litigated in the court of Amsterdam. Each of the parties consents to jurisdiction
108 0fd75c45 2022-07-30 mischa in such Court and agrees that service of process as provided by the states and rules
109 0fd75c45 2022-07-30 mischa of civil procedures of the Netherlands shall be sufficient.
